Structured Settlement Transfers

North Dakota has become the most recent state to adopt a Structured Settlement Transfer Statute. The statute was signed by the governor on March 23, 2009 and is effective on transfers entered into on or after August 1, 2009. North Dakota becomes the forty seventh state to enact such a statute.

The statute, entitled "Structured Settlement Transfers" is found in chapter 32-03.4 of the North Dakota Century Code and is very similar to the "Model State Structured Settlement Protection Act that was adopted in September, 2000 by the National Structured Settlements Trade Association ("NSSTA") and the National Association of Settlement Purchasers ("NASP"). A copy of the statute can be found at http://www.legis.nd.gov/cencode/t32c034.pdf
